Donation and Participation Agreement

By submitting a donation to participate in the 2026 Three Trees Invitational (the “Event”), I, the participant (“Participant”), acknowledge and agree to the following terms:

1. Donation and Tax Treatment
   The payment made in connection with participation in the Event is a charitable donation to Three Trees Foundation, a 501(c)(3) nonprofit organization. The donation is non-refundable, regardless of participation status or event cancellation due to unforeseen circumstances. To the extent that the donation exceeds the fair market value of any goods or services received, it may be tax-deductible under applicable law. Participants should consult a tax advisor regarding deductibility.

2. Assumption of Risk and Liability Waiver
   Participant understands and acknowledges that participation in the Event involves inherent risks, including but not limited to injury, illness, or property damage. Participant voluntarily assumes all such risks and hereby releases, waives, and discharges Three Trees Foundation, event organizers, sponsors, volunteers, venue operators, and any affiliated parties from any and all claims, liabilities, damages, or expenses arising from or related to participation in the Event.

3. Indemnification
   Participant agrees to indemnify and hold harmless Three Trees Foundation and all associated parties from any claims, losses, or liabilities incurred as a result of Participant’s actions during the Event.

4. Media Release
   Participant grants Three Trees Foundation and its affiliates the irrevocable right to use their name, image, likeness, and any photographs, video, or recordings of the Event for promotional, fundraising, and marketing purposes without compensation.

5. Compliance with Event Rules
   Participant agrees to abide by all Event rules, regulations, and instructions provided by organizers. Failure to comply may result in disqualification without refund.

6. Force Majeure
   In the event of circumstances beyond the control of the organizers, including but not limited to extreme weather, acts of God, public emergencies, or governmental restrictions, the Event may be postponed or canceled without obligation for refund.

7. Governing Law and Dispute Resolution
   This Agreement shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes shall be resolved through mediation or binding arbitration in Harris County, Texas.

By submitting my donation and participating in the Event, I acknowledge that I have read, understood, and agreed to the terms above.
